The Human Rights Commission (NHRC) of India is an autonomous public body constituted on 12 October 1993 under the Protection of Human Rights Ordinance of 28 September 1993.
The Chairperson and members of the NHRC are appointed by the President of India, on the recommendation of a committee consisting of:

(bullet) The Home Minister

(bullet) The Leader of the Opposition in the Lok Sabha (Lower House)

(bullet) The Leader of the Opposition in the Rajya Sabha (Upper House)

(bullet) The Speaker of the Lok Sabha (Lower House)

(bullet) The Deputy Chairman of the Rajya Sabha
A person who is a retired Chief justice of the Supreme Court of India can only be appointed as the chairman of the National Human Rights Commission.
